Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the PostPilot Live platform and services operated at postpilotlive.com ("Service"), owned and operated by Vernon Lee ("we," "us," or "our"). By creating an account or using PostPilot Live, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Service Description

PostPilot Live is a social media automation platform designed for restaurants. We use artificial intelligence to generate social media posts and automatically publish them to your connected accounts on Facebook, Instagram, Google Business Profile, and TikTok. The Service includes content generation, scheduling, publishing, and performance analytics.

3. Account Registration

  • You must provide accurate, complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old and authorized to act on behalf of the restaurant you register.
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately at hello@postpilotlive.com if you suspect unauthorized access to your account.

4. Subscription and Billing

  • PostPilot Live is offered as a paid subscription at $79 per month per restaurant location.
  • New accounts include a 14-day free trial. You will not be charged until the trial period ends.
  • After the trial, your subscription will automatically renew monthly unless cancelled.
  • You may cancel your subscription at any time from your dashboard or by contacting us. Cancellation takes effect at the end of your current billing period.
  • We do not offer refunds for partial billing periods. If you cancel mid-cycle, you retain access until the end of the paid period.
  • Payments are processed securely through Stripe. By subscribing, you agree to Stripe's terms of service.
  • We reserve the right to change pricing with 30 days' notice via email. Price changes will apply at your next billing cycle after the notice period.

5. Content Ownership and License

  • Your content: You retain ownership of all content related to your restaurant, including photos, logos, descriptions, and other materials you provide.
  • Generated content: Social media posts generated by PostPilot Live on your behalf are owned by you. You may use, modify, or redistribute them as you wish.
  • License to us: You grant PostPilot Live a non-exclusive, worldwide license to use your restaurant information and content solely for the purpose of providing the Service (generating and publishing posts, displaying analytics, etc.).
  • Our content: The PostPilot Live platform, branding, design, and technology remain our intellectual property.

6. Connected Social Media Accounts

By connecting your social media accounts to PostPilot Live, you:

  • Authorize us to publish content to those accounts on your behalf.
  • Confirm that you have the authority to manage those accounts.
  • Understand that you can disconnect any account at any time from your dashboard.
  • Acknowledge that platform-specific terms (Meta, Google, TikTok) also apply to content published through their services.

7. Acceptable Use

You agree not to use PostPilot Live to:

  • Publish content that is illegal, defamatory, obscene, or infringes on the rights of others.
  • Impersonate another person or business, or misrepresent your affiliation.
  • Attempt to access other users' accounts or data.
  • Use the Service for any business other than a legitimate food and beverage establishment.
  • Interfere with or disrupt the Service, servers, or networks.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Resell or redistribute the Service without our written consent.

8. AI-Generated Content

PostPilot Live uses artificial intelligence (powered by OpenAI) to generate social media content for your restaurant. While we strive for high-quality output, AI-generated content may occasionally contain errors or inaccuracies. You are responsible for reviewing posts before they are published (if you choose to enable review mode) and for any content posted to your social media accounts. We are not liable for the accuracy or appropriateness of AI-generated content.

9. Service Availability

We strive to maintain high uptime, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control (including third-party API outages from Meta, Google, or TikTok). We are not liable for any losses resulting from service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, PostPilot Live and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 3 months preceding the claim. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

11. Indemnification

You agree to indemnify and hold harmless PostPilot Live and its owner from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or content published to your social media accounts through PostPilot Live.

12. Termination

  • You may terminate your account at any time by cancelling your subscription and contacting us to request account deletion.
  • We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or fail to pay subscription fees.
  • Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.
  • Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will remain in effect.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, binding arbitration.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of PostPilot Live after changes are posted constitutes your acceptance of the updated Terms.
